WakeAI Terms of Use

1. Acceptance of Terms

By downloading or using WakeAI you agree to these Terms of Use. If you do not agree, do not use the app.

2. Description of Service

WakeAI is a behavioural operating system that learns your patterns and helps manage your daily life through AI-powered alarms, reminders, calendar management, and behavioural insights.

3. Eligibility

You must be at least 13 years old to use WakeAI. By using the app you confirm you meet this requirement.

4. Subscriptions

WakeAI offers free and paid subscription tiers. Paid subscriptions are processed through Apple's App Store and are subject to Apple's payment terms.

• Essential — $9.99/month or $2.99/week
• Pro — $19.99/month or $5.99/week
• All paid plans include a 3-day free trial for new subscribers
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• You can manage and cancel subscriptions in your Apple ID account settings
• No refunds are provided for partial subscription periods

5. Acceptable Use

You agree not to:

• Use WakeAI for any unlawful purpose
• Attempt to reverse engineer, decompile, or extract source code from the app
• Use automated tools to access or scrape the app
• Attempt to gain unauthorised access to any part of the service or its infrastructure
• Use the app in any way that could damage, disable, or impair the service

6. AI Features

WakeAI uses artificial intelligence to generate responses and suggestions. AI-generated content may not always be accurate. You are responsible for verifying any important information before acting on it. WakeAI is not responsible for decisions made based on AI suggestions.

7. Health and Safety

WakeAI integrates with Apple HealthKit to display health data. WakeAI is not a medical device and does not provide medical advice. Do not rely on WakeAI for medical decisions. Always consult a qualified healthcare professional for health concerns.

8. Privacy

Your use of WakeAI is also governed by our Privacy Policy, available at https://abz119.github.io/wakeai-privacy. By using WakeAI you agree to the collection and use of data as described in the Privacy Policy.

9. Intellectual Property

All content, features, and functionality of WakeAI including but not limited to the behavioural engine, user interface, and branding are owned by WakeAI and protected by applicable intellectual property laws.

10. Disclaimer of Warranties

WakeAI is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the service will be uninterrupted, error-free, or free of harmful components.

11. Limitation of Liability

To the maximum extent permitted by law, WakeAI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the app, including but not limited to missed alarms, missed appointments, or decisions made based on AI suggestions.

12. Termination

We reserve the right to suspend or terminate your access to WakeAI at any time for violation of these terms or for any other reason at our discretion.

13. Changes to Terms

We may update these terms from time to time. Continued use of the app after changes constitutes acceptance of the updated terms.

14. Governing Law

These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
